Passed by the Council Dec 9, 1914 and submitted to the voters at the special election of Jan 18, 1915, with the Notice of Special Town Election on the first sheet. Twelve sections set construction standards, line extensions (300 ft free per half-kilowatt of applicants' lamps), street-repair and house-moving rules, 24-hour alternating-current service, lighting rates of 16, 14 and 9 cents per kWh with a 1-cent prompt-pay discount and $1.00 minimum, power rates of 10, 6 and 4 cents per kWh, and five-year rate terms. The Town agrees to at least eight 100-watt street lamps on an all-night schedule at $25.00 per lamp per year for ten years, and 5 cents per kWh for pumping if it builds a municipal water plant. Ends with Mayor Martin's signed certificate that the notice was posted for four weeks at the Post Office, the Mayor's Office and a third place. The only 1910s Dana ordinance whose full text is known to survive; the minutes book records passage only. Found loose, folded into the Council minutes book near pages 35-44 (Dec 1914 - Feb 1915).</text>

AN ORDINANCE AMENDING THE DANA MUNICIPAL CODE OF 1993 BY AMENDING SECTION 92.04 TO PROVIDE FOR DISCONTINUANCE OF WATER SERVICE TO DELINQUENT WATER CUSTOMERS

Be it enacted by the City Council of Dana, Iowa:

SEC. 1. Section 92.04 of the Dana Municipal Code of 1993 is hereby repealed and new Section 92.04 is adopted in lieu thereof as follows:

Section 92.04 Water service to delinquent customers may be discontinued in accordance with the following: (Code of Iowa, Sec. 384.84)

1. Notice. The Clerk shall send to each delinquent customer a written notice by ordinary mail informing the delinquent customer of the nature of the delinquency and affording the customer the opportunity for a hearing prior to discontinuance of service. If the delinquent customer is a tenant of the premises, and if the owner or landlord of the premises has made a written request for notice, the notice shall also be given to the owner or landlord.

2. Service Discontinued. After the Notice(s) provided for above and after an opportunity for the delinquent customer or the owner or landlord to appear before the Council for a hearing, if the account remains delinquent, the Superintendent shall have the authority to discontinue water service to the premises by shutting off the supply of water to the delinquent customer.

3. Fees. A turn-on fee of twenty-five dollars ($25.00) shall be charged before service is restored to a delinquent customer. If the customer has not previously paid a deposit, then a fifty dollar ($50.00) deposit shall be required in addition to the turn-on fee. No turn-on fee or service fee shall be charged for the usual or customary trips in the regular changes in occupancies of property.

SEC. 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

SEC. 3. Severability clause. If any section, provision or part of this ordinance shall be adjudged unconstitutional or invalid, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

SEC. 4. When effective. This ordinance shall be in effect after its final passage, approval and publication as provided by law.

Passed by the Council the 17th day of August, 1994, and approved this 17th day of August, 1994.

LIMITED EASEMENT

RE: City of Dana, Iowa, a municipal corporation.
Lot Sixteen (16) in the Subdivision of Lot Twelve (12), in the Southwest Quarter (SW 1/4) of Section Four (4), Township Eighty-four (84) North, Range Twenty-nine (29) West of the 5th P.M., Greene County, Iowa; and that part of Lot B of the Subdivision of Lot Twenty-two (22) in the Southwest Quarter (SW 1/4) of the Southwest Quarter (SW 1/4) of Section Four (4), Township Eighty-four (84) North, Range Twenty-nine (29) West of the 5th P.M., Greene County, Iowa; described as follows: Beginning at a point on the South line of said Lot B which is 130 feet west of the Southeast Corner of said Lot B; thence N 55° E 54.0 feet; thence N 35° W 20.0 feet; thence S 55° W 82.56 feet to said South line of Lot B; thence East 34.87 feet to the point of beginning.

The undersigned, as Owner(s) of record of the real estate described above, for one dollar and other good and valuable consideration received, hereby grant(s), sell(s), transfer(s) and convey(s) to Xenia Rural Water District (the "District"), its successors and assigns, an affirmative and perpetual easement in, to, and running with the real estate described above, together with a general and perpetual right of ingress and egress upon such real estate, LIMITED AS FOLLOWS:

1. This easement is solely for the general purposes of construction and laying and thereafter using, operating, inspecting, maintaining, repairing, replacing or removing water pipeline and any necessary appurtenances thereto over, across and through the real estate described above; and,

2. Once such water pipeline and any necessary appurtenances thereto are installed and operating, then this easement (except the general rights of ingress and egress) shall be automatically reduced in scope to a width of thirty feet, the centerline of which shall be the water pipeline and any necessary appurtenances thereto.

It is agreed that, during the period of initial construction, no crop damage will be paid by the District. The District, its successors and assigns, hereby promise to maintain such water pipeline and any necessary appurtenances in good repair so that damage to adjacent real estate of Owner(s), if any damage there be, will be kept to a minimum. Said pipeline shall be placed within 30 feet from and adjacent to existing road right-of-way; provided, however, that grantee may deviate from said course to avoid natural and/or manmade barriers or obstructions.

The District further agrees:
1. To repair, or pay to repair, any tile lines and fences injured or destroyed during construction and in the course of maintenance thereafter.

2. To pay for any crops damaged or destroyed in the course of maintenance beginning one year from the date of initial construction.

3. As long as there is adequate water available, the Owner or successor Owners of the above described property may, by paying the current membership fee and other associated costs at that time, avail themselves to any number of water service hook-ups.
