RESOLUTION 97-2
A RESOLUTION EXTENDING DURATION OF THE GREENE COUNTY RECYCLING AGENCY
WHERE AS: On july 1, 1992, the Cities and Greene County Supervisors executed
that Agreement Creating Greene County Recycling Agency, filed with the Iowa
Secretary of State on July 14, 1992, and recorded in theOffice of the Greene
County Recorditor on October 16, 1992, in Book 20 at Page 661 (the Agency
Agreement"), for thr purpose of creating pursurant to the provisions of Chapter
28E of the Code of 28E of the Code pf Iowa the Greene County recycling (the "Agency").
Pursuant to Section 4.1 of the Agency Agreement it was provided that
the Agency shall continue until June 30, 1997, at at which time it was to
automatically terminate unless extended by agreement of all Members. The Members
desire to extend the desire to extend the duration of the Agency indefinitely
and therefore have agreed to amend the Agency Agreenebt to provide that the
duration of the Agency shall be perpetual.
The Amendment
In consideration of the foregoing recitals, the members of the Greene
County Recycling Agency have agreed to amend the Agency Agreement as foldows:
1. Section 4.1 of the Agency Agreement is deleted and the following
1ew Section 4.1 is substituted in lieu thereof:
4.1 Duration. The duration of this Agency
shall be perpetual.
2. Except as expressly modified by this Agency Extension Agreement all
terms and provisions of the Agreement Creating Greene County Recycling Agency
shall remain in full force and effect.
