RESOLUTION AUTHORIZING SALE OF VACATED PART OF NORTH STREET, BETWEEN DANA'S FIRST AND SECOND ADDITIONS, ORIGINAL TOWN (NOW CITY) OF DANA
WHEREAS, by resolution adopted October 20, 1993, the City Council of Dana proposed to re-convey to Juhl Feed, Inc. a certain part of North Street located in the City of Dana, all as more particularly described below; and
WHEREAS, the portion of North Street which is proposed to be re-conveyed has been vacated by ordinance in the manner provided by law; and
WHEREAS, notice of a public hearing on the City's proposal to sell such portion of vacated part of North Street has been published as required by law; and
WHEREAS, the public hearing has been held at the time and place as specified in the notice and any and all objections or other comments relating to such proposal have been heard; and
WHEREAS, it is deemed to be in the best interests of the City of Dana, Iowa, that such portion of vacated North Street be sold and re-conveyed as proposed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DANA, IOWA, as follows:
1. That the City of Dana sell and convey by quit claim deed to Juhl Feed, Inc. the following-described portion of North Street:
The West 212.30 feet of the East 313.18 feet of North Street in the Town of Dana, Iowa, which is also described as all that part of North Street in the Town of Dana, Greene County, Iowa, lying adjacent to and south of Lot Five (5) and the East 80.30 feet of Lot Four (4) of the Irregular Survey of the Southwest Quarter of the Southwest Quarter (SW¼ SW¼) of Section Four (4), Township Eighty-four (84) North, Range Twenty-nine (29) West of the 5th P.M., Greene County, Iowa;
for the sum of $1.00 and upon the City receiving reimbursement for its publication and recording costs incurred in connection with the vacation and sale of this portion of North Street.

2. Such sale and conveyance shall be subject to all existing franchises, easements, licenses and permits, whether or not of record, and shall reserve unto City an easement for purposes of the presence, operation, maintenance, repair and replacement of all existing utilities.
3. That Jack Pedersen, Mayor and George Brabbs, City Clerk, are authorized and directed to execute and deliver a quit claim deed to effect the foregoing sale and conveyance to Juhl Feed, Inc.
4. Any part or all of any resolutions and orders in conflict with this Resolution, to the extent of such conflict, is hereby repealed, and this resolution shall be in full force and effect immediately upon its adoption.
