RESOLUTION NO, 94-5
RESOLUTION AUTHORIZING PURCHASE OF REAL ESTATE

WHEREAS, it is in the best interests of the City of Dana to

acquire certain real estate located in the City of Dana, described
as follows: :

The South Sixty-six feet (S 66’) of Lot Six (6) in
the Southwest Quarter of the Southwest Quarter (SW1/4
SW1/4) of Section Four (4), Township Eighty-four (84)
North, Range Twenty-nine (29) West of the 5th P.M.,
Greene County, Iowa ("the Real Estate").

WHEREAS, the Real Estate is presently titled in the name of
Albert M. Cooper and Brownie Cooper, husband and wife, and they

have agreed to give the City a Quit Claim Deed to convey the
premises to the City.

WHEREAS, the Real Estate has in the past been possessed by
Scott Tucker and Danny Coleman even though the Real Estate is
presently titled in the name of Albert M. Cooper and Brownie
Cooper, husband and wife, and the City Council desires to obtain
Quit Claim Deeds from those persons and their spouses, if any.

WHEREAS, the City Council of the City of Dana, Iowa, deems it
to be in the best interests of the City to accept the Cooper Quit
Claim Deed from the Coopers and to file the deed with the Office of
the Greene County Recorder, and to try to obtain Quit Claim Deeds
from Tucker and Coleman and their spouses, if any.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
Dana, Iowa, that the Mayor and Clerk are hereby authorized and
directed to accept the Quit Claim Deed described above from Albert
M. Cooper and Brownie Cooper, husband and wife, and to file the
deed with the Office of the Greene County Recorder, and to try to
obtain additional Quit Claim Deeds from Scott Tucker and Danny
Coleman and file those Deeds with the Recorder.

PASSED AND ADOPTED on this 21st day of September , 1994.

City Clerk of the City of Dana and that as such I have in my
possession, or have access to, the complete corporate records of
said City and of its Council and its officers; that I have
carefully compared the foregoing transcript of resolution with said
records; that said transcript of resolution is a true, correct and
complete copy of the City’s records in relation to the matter
covered by the resolution and that at the City Council meeting at
which said resolution was adopted a quorum was present and the

resolution was duly adopted pursuant to motion made, seconded and
carried.
