RESOLUTION NO. 94-6

RESOLUTION AUTHORIZING PURCHASE OF REAL ESTATE

WHEREAS, on or about the 20th day of July , 1994, the
City of Dana sent to Francis W. Zimmerle and Deborah F. Zimmerle at
506 East Street, Jefferson, IA 50129, a Notice to Abate Nuisance to
demand that Zimmerles abate a nuisance consisting of the existence
of a dangerous tree on property owned by Zimmerles at 306 Anyer
Street in Dana;

WHEREAS, the City directed Zimmerles to abate the nuisance by
removal of the tree that was located on the following-described
property:

The West One Half (W1/2) of Lot One (1), Block
One (1), Original Town of Dana ("the
Property") ;

WHEREAS, the City also gave Zimmerles notice of their right

to request a hearing before the City Council regarding the issue of
the existence of the nuisance and removal of the tree;

WHEREAS, Zimmerles did not request a hearing with the City
Council and has not removed the tree or otherwise abated the
nuisance; and

WHEREAS, the dangerous tree condition still exits on the
Zimmerle Property; the tree is a nuisance; and the City should
cause the nuisance to be abated by causing the removal of the tree.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
Dana, Iowa, that the Mayor and Clerk are hereby authorized and
directed to contract with a tree removal firm or company and to
otherwise handle all necessary arrangements for the removal of the
nuisance on the Zimmerle Property by removal of the dangerous tree
located thereon.

BE IT FURTHER RESOLVED by the City Council of the City that
the costs of removal of the Zimmerles’ tree be assessed against
Zimmerles and the Zimmerle Property as provided by law.

which said resolution was adopted a quorum was present and the
resolution was duly adopted pursuant to motion made, seconded and
carried.
